Construction Disputes in Pakistan: When the Builder Does Not Deliver

Construction disputes are common in Pakistan. If a contractor fails to deliver on time or delivers defective work, the property owner has several remedies. First, review the construction agreement — most contain penalty clauses for delay and provisions for rectification of defects. Second, send a legal notice giving the contractor a reasonable time (typically 15-30 days) to cure the deficiency. Third, if the contractor fails to comply, file a civil suit for damages, specific performance, or both. For large projects with arbitration clauses, the dispute goes to arbitration. In extreme cases (fraud, criminal breach of trust), an FIR can be filed.
