Our Family Law Services

Khula & Dissolution of Marriage

Filing khula suits before the Family Court under the Dissolution of Muslim Marriages Act 1939 and the West Pakistan Family Courts Act 1964. Khula is a wife's right to seek dissolution of marriage. The court grants dissolution after the mandatory reconciliation process (typically 90 days). The wife may be required to return the dower (mehr) or a portion of it.

LexForm files khula petitions, represents you in Family Court, and negotiates favourable terms for dower, custody, and maintenance in the dissolution settlement.

Talaq & Divorce Procedures

Processing divorce under the Muslim Family Laws Ordinance 1961. The husband must issue written notice of talaq to the Chairman of the Union Council and to the wife. The divorce becomes effective after 90 days. We handle the S.7 notice, Union Council reconciliation proceedings, and obtain the divorce certificate. For overseas Pakistanis, we coordinate the process through the relevant Union Council or Embassy.

LexForm manages the entire talaq process from notice to final certificate, including coordination for overseas Pakistanis.

Child Custody & Visitation

Representing parents in custody (hizanat) disputes under the Guardians and Wards Act 1890. Under Pakistani law, the mother has the right of custody (hizanat) for boys until age 7 and girls until puberty, after which the father becomes the natural guardian. The overriding principle is the welfare of the child (S.17 Guardians and Wards Act). We also handle visitation rights, custody modification, and international custody disputes involving the Hague Convention.

LexForm advocates for the child's best interest while protecting your parental rights. We handle contested custody, visitation enforcement, and cross-border custody disputes.

Maintenance (Nafaqa) & Dower Recovery

Filing maintenance suits for wives and children before the Family Court. The husband is legally obligated to maintain his wife during marriage and during the iddat period after divorce. Children's maintenance continues until sons are self-supporting and daughters are married. Dower (mehr) recovery suits are filed when the husband fails to pay the agreed-upon dower. Family Courts can also order recovery of dowry articles (jahez) wrongfully retained.

LexForm files maintenance and dower suits, obtains interim maintenance orders, and enforces payment through execution proceedings.

Guardianship & Succession

Obtaining guardianship certificates under the Guardians and Wards Act 1890 for minors whose parents are absent, incapacitated, or deceased. Succession certificates under the Succession Act 1925 for heirs to claim bank deposits, shares, and other assets of the deceased. We advise on inheritance shares under Muslim personal law (Sharia) and handle disputes over distribution of estate.

LexForm obtains guardianship and succession certificates, advises on Islamic inheritance shares, and resolves estate disputes.

Domestic Violence Protection

Filing for protection orders under the Domestic Violence (Prevention and Protection) Act 2012 (ICT) and equivalent provincial laws. The court can issue immediate protection orders, residence orders, and monetary relief orders. We also advise on criminal remedies under PPC sections 337-A (hurt), 506 (criminal intimidation), and 498-A (cruelty to a woman by husband or in-laws).

LexForm provides urgent assistance in domestic violence situations, obtains emergency protection orders, and pursues criminal prosecution where appropriate.

Frequently Asked Questions

How does khula (wife-initiated divorce) work in Pakistan?+

A wife can seek khula through the Family Court by filing a suit for dissolution of marriage. She may need to return her mehr (dower). The court attempts reconciliation, and if unsuccessful, grants the decree. The process typically takes 3-6 months.

What are the child custody rules in Pakistan?+

Under the Guardians and Wards Act 1890, the welfare of the child is paramount. Generally, mothers have custody (hizanat) of boys until age 7 and girls until puberty, but courts consider the child's best interests above all.

How is maintenance (nafaqa) determined in family cases?+

Maintenance is determined by the Family Court based on the husband's income and financial capacity, the wife's needs, the standard of living, and the number of dependents. Both spouses and children are entitled to maintenance.
