Dower (Mehr) Recovery: How to Claim Your Deferred Mehr

How to file a suit for recovery of dower in the Family Court, including prompt and deferred mehr distinctions.

Dower (mehr) is the wife's absolute right under Islamic law. It consists of prompt mehr (payable on demand) and deferred mehr (payable on divorce or death). If the husband fails to pay, the wife can file a suit in the Family Court for recovery. The suit must be filed within 3 years of the cause of action (demand or divorce). The court can order payment in installments if the husband demonstrates financial hardship. Mehr is a priority debt in the husband's estate — it must be paid before distribution of inheritance.
