Bail FAQs: Pakistan

Last updated: March 2026 · By LexForm Research

What is the difference between pre-arrest and post-arrest bail?

Pre-arrest bail (Section 498 CrPC) is sought before arrest — you ask the court for protection from arrest. Post-arrest bail (Section 497 CrPC) is sought after you have been arrested and are in custody. Both require different strategies.

How quickly can I get bail?

Pre-arrest bail can sometimes be obtained the same day if the matter is urgent. Post-arrest bail typically takes 2-7 days depending on court schedules. In bailable offences, bail is a right and should be granted immediately.

Can bail be cancelled?

Yes. If the accused violates bail conditions, flees jurisdiction, tampers with evidence, threatens witnesses, or commits another offence while on bail, the prosecution can apply for bail cancellation.

What is the difference between bailable and non-bailable offences?

In bailable offences, bail is a matter of right — the police or court must grant it. In non-bailable offences, bail is at the court's discretion and depends on factors like severity, evidence, and flight risk.
