Guardianship of a minor's person (custody) and property (estate) is governed by the Guardians and Wards Act 1890. The father is the natural guardian of a minor's property. If the father is deceased, the court appoints a guardian on the application of a relative or the minor's mother. The court considers: the welfare of the minor, the proposed guardian's character and capacity, the minor's preference (if old enough), and kinship. The guardian must manage the minor's property prudently and account to the court annually.
