Partition Suit in Pakistan: How to Divide Property Among Co-Owners or Heirs
When co-owners or heirs cannot agree on property division, how to file a partition suit and what the court can order.
When co-owners (whether by purchase or inheritance) cannot agree on how to divide property, any co-owner can file a partition suit under S.4 of the Partition Act 1893 or O.XX R.18 CPC. The court appoints a Local Commissioner to physically inspect the property and propose a division plan. If physical division is possible, the court divides the property among the co-owners according to their shares. If physical division is not practicable (e.g., a single plot too small to divide meaningfully), the court orders sale and distribution of proceeds. The suit must be filed in the civil court where the property is situated.
