Second Marriage Without First Wife's Permission: Legal Consequences

The legal position on polygamy in Pakistan under the Muslim Family Laws Ordinance and the consequences of marrying without permission.

Under S.6 of the Muslim Family Laws Ordinance 1961, a husband cannot contract a second marriage without the prior written permission of the Arbitration Council. The husband must apply to the Chairman of the Union Council, who will constitute an Arbitration Council including representatives of both the existing wife and the proposed wife. Permission is granted only if the Council is satisfied that the proposed marriage is necessary and just. Contracting a second marriage without permission is an offence punishable with imprisonment up to one year and fine up to Rs. 5,000. The existing wife can also seek dissolution on this ground.
