Trademark Infringement in Pakistan: Legal Remedies and Enforcement

When a registered trademark is infringed, the proprietor has both civil and criminal remedies. Civil remedies include injunctions (temporary and permanent), damages or account of profits, and delivery up of infringing goods. Criminal penalties under S.73-79 TMO include imprisonment up to 3 years and fine. The IP Tribunal has exclusive jurisdiction over civil infringement claims. Criminal complaints can be filed with the FIA Cyber Crime Wing (for online counterfeiting) or local police. Customs can also be engaged for border seizure of counterfeit goods.
