When can a government servant challenge a transfer order, and what remedies are available?
Transfer is a prerogative of the employer, but it must be exercised in good faith. A government servant can challenge a transfer order before the Service Tribunal if: it amounts to a reduction in rank or emoluments (disguised punishment), it is mala fide (motivated by personal vendetta rather than administrative necessity), or it violates the relevant service rules. The Tribunal can suspend the transfer order pending hearing and set it aside if found unlawful. Courts have held that transfer to a hardship posting without rotation among all eligible officers may constitute victimisation.
