NOTICE OF PRONOUNCEMENT OF TALAQ UNDER SECTION 7, MUSLIM FAMILY LAWS ORDINANCE 1961

FORMAL NOTICE OF PRONOUNCEMENT OF TALAQ (DIVORCE)

1. I, husband_name, holder of CNIC No. husband_cnic, resident of husband_address, hereby give formal written notice of pronouncement of talaq (divorce) to my wife, wife_name, holder of CNIC No. wife_cnic, resident of wife_address, in accordance with the provisions of Section 7 of the Muslim Family Laws Ordinance 1961. 2. PARTICULARS OF NIKAH: I was united in marriage with the aforesaid wife on nikah_date (nikah_islamic_date). The nikah was solemnized at nikah_place by nikah_solemnizer. The nikah was registered with the Nikah Registrar, union_council_name, under Registration No. nikah_registration_number. 3. PRONOUNCEMENT OF TALAQ: I hereby pronounce talaq upon my aforesaid wife. This talaq is pronounced on talaq_date (talaq_islamic_date). 4. GROUNDS FOR TALAQ: The reasons compelling me to pronounce talaq are as follows: talaq_grounds 5. ATTEMPTS AT RECONCILIATION: Prior to pronouncing talaq, I have attempted reconciliation with my wife through the following measures: reconciliation_attempts 6. However, it has become impossible to continue the marital relationship due to the circumstances mentioned above. 7. Pursuant to Section 7 of the Muslim Family Laws Ordinance 1961, this talaq shall become effective on talaq_effective_date, which is ninety (90) days from the date of this notice, unless during this period the marriage is revoked by mutual consent or by my revocation of talaq. 8. During the waiting period (iddah) of ninety (90) days from the date of this notice, I am fulfilling all maintenance obligations to my wife as required under Islamic law and the provisions of the said Ordinance. 9. I hereby request that the Arbitration Council conduct proceedings to attempt reconciliation between myself and my wife during the prescribed waiting period, as mandated under Section 7(3) of the Muslim Family Laws Ordinance 1961. 10. A copy of this notice is being simultaneously served upon my wife at her above-mentioned address.

WHEREFORE, I respectfully request that: (1) This notice of pronouncement of talaq be recorded and acknowledged by this Honourable Council; (2) A copy of this notice be served upon my wife as required under Section 7 of the Muslim Family Laws Ordinance 1961; (3) This Honourable Council conduct proceedings for reconciliation during the waiting period of ninety (90) days; (4) If reconciliation is not achieved within the waiting period, this talaq shall become final and the marriage shall be dissolved; and (5) All ancillary matters, including maintenance, dower (mahr), and division of property, be resolved in accordance with applicable law.

That the Applicant approaches this Honourable Court / Authority with clean hands, has made full and frank disclosure of all material facts, and has not concealed anything material to the just decision of the application.

That the present application is filed in good faith, at the earliest available opportunity, and is otherwise within the period of limitation prescribed by law.

That no prejudice will be caused to the Respondent / opposite party by grant of the relief sought; on the contrary, refusal of the relief would cause irreparable injury and hardship to the Applicant for which no adequate remedy is available in damages.

That the Applicant undertakes to abide by all directions and conditions that this Honourable Court / Authority may impose on the grant of relief, and to deposit any costs or undertakings as may be required.

PRAYER

In view of the foregoing, the Applicant / Petitioner / Complainant most respectfully prays that the Honourable Authority may be pleased to:

(a) Receive the present notice of pronouncement of talaq under Section 7 of the Muslim Family Laws Ordinance 1961;

(b) Constitute the Arbitration Council and conduct reconciliation proceedings between the parties in accordance with Section 7;

(c) On expiry of ninety days from the date of receipt of this notice without reconciliation, issue the certificate confirming that the talaq has become effective;

(d) Communicate the certificate to the parties and to the Nikah Registrar concerned; and

(e) Pass any other order that the Arbitration Council may consider just, fit, and proper.

I, husband_name, solemnly affirm on oath that the contents of this notice are true to the best of my knowledge and belief. I further declare that I am of sound mind and that this pronouncement of talaq is made in full exercise of my will and authority.
