APPLICATION FOR RELEASE OF DETAINED GOODS UNDER SECTION 179 OF THE CUSTOMS ACT 1969

The applicant hereby respectfully submits this application for release of goods detained under the Customs Act 1969 on the following grounds:

1. The applicant is the importer of record and owner of the goods described hereinafter, which stand detained at customs_location since detention_date. The goods form part of a lawful commercial import consignment and are subject to lawful customs procedures. The applicant has full legal right and title to the goods and is seeking their release.

2. The goods in question consist of goods_description, comprising goods_quantity unit_of_measurement, bearing HS Code hs_code, country of origin country_of_origin, with customs entry number entry_number dated entry_date, Bill of Lading bill_of_lading_number dated bill_of_lading_date, with an assessed value of PKR assessed_value and an Import General Manifest (IGM) reference igm_number.

3. The detention of the said goods was ordered on detention_date by the Customs Officer detention_officer_name on the unsubstantiated allegation that the goods were imported in violation of alleged_violation and additional_alleged_ground. The applicant respectfully but firmly contends that the said allegation is baseless, without factual foundation, and wholly unjustified.

4. The applicant has been caused substantial and ongoing financial loss by reason of the prolonged detention. The goods have been in official custody for detention_days days and are goods_condition_issue in quality and market value. The delay in release has resulted in direct loss of business opportunity valued at PKR loss_of_opportunity, failure to meet contractual obligations to buyer_details, and exposure to contractual penalties of PKR contractual_penalty.

5. The applicant has taken immediate steps to remedy the alleged violation. remedial_steps_taken. compliance_measures. The applicant has produced evidence of compliance in the form of evidence_type. The grounds for continued detention no longer exist.

6. The applicant is prepared and willing to furnish an indemnity bond/bank guarantee in the sum of PKR bond_amount as security against the released goods and to comply with all lawful directions of the Customs department pending final adjudication of the case. The applicant further submits that the said bond shall remain in force until the final adjudication of the case is concluded and any outstanding dues are paid.

7. The applicant submits that release of goods on furnishing of adequate security is not only justified but is mandated by the provisions of Section 168 of the Customs Act 1969, which empowers the Collector to permit release of detained goods on such terms and conditions as deemed appropriate. Continued detention without release is an abuse of discretion.

8. The applicant further submits that the prolonged detention of goods on mere allegation, without proper adjudication or establishment of violation, constitutes a violation of the principles of natural justice. The applicant is entitled to a fair hearing and an opportunity to be heard before a final decision is made. The detention period detention_days days is excessive and unreasonable.

WHEREFORE, the applicant respectfully and humbly prays that this Hon'ble Collector of Customs (Adjudication) may be pleased to: (a) Allow the present application; (b) Direct the Customs authorities to immediately release the goods in question to the applicant on furnishing of an indemnity bond or bank guarantee in the sum of PKR bond_amount, to be held as security pending final adjudication; (c) Fix reasonable terms and conditions for the release that are not unduly burdensome on the applicant; (d) Pass such further and other orders as this Hon'ble Collector may deem fit and proper in the circumstances of the case, in the interest of justice and equity.
