APPLICATION FOR REFUND OF COURT FEES
Respectfully sheweth:
1. That the applicant is the plaintiff in the captioned suit, instituted on plaint_filing_date, on a court fee of Rs. court_fee_paid, paid by way of mode_of_payment, on the basis of the valuation set out in the plaint.
2. That the present application is being moved on the ground of ground_for_refund (excess valuation / suit compromised / suit withdrawn before contest / plaint returned for presentation in proper court / plaint rejected on technical grounds / any other ground specified under Section 13).
3. That the basis upon which the refund is claimed is set out in detail as under: detailed_basis. Briefly, the proceedings have not resulted in a contested adjudication on the merits within the meaning of Section 13, and the conditions for refund prescribed thereunder are duly satisfied in the present case.
4. That the original / certified copy of the receipt of payment of court fees, along with such other documents as evidence the basis for refund (compromise, withdrawal, return order, etc.), is annexed for the kind perusal of this Honourable Court.
5. That the applicant has not previously applied for or received any refund of the court fees in question, and a refund is admissible in law in accordance with the principles laid down by the superior courts. The application is well within the period of limitation prescribed by the Limitation Act 1908 / the rules made under the Court Fees Act.
PRAYER
It is, therefore, most respectfully prayed that this Honourable Court may be pleased to:
(a) Direct the refund of the court fees in the sum of Rs. refund_claimed to the applicant under Section 13 of the Court Fees Act 1870;
(b) Issue the necessary refund certificate / order in favour of the applicant, addressed to the revenue_authority for processing the refund; and
(c) Pass any other order as this Honourable Court may deem just and proper in the circumstances of the case.
