CRIMINAL REVISION PETITION UNDER SECTIONS 435 AND 439 OF THE CODE OF CRIMINAL PROCEDURE 1898

Respectfully sheweth:

1. That the Petitioner is aggrieved by the order dated impugned_order_date, passed by lower_court_designation, lower_court_location, in case_title, Case No. case_number.

2. That the impugned order is nature_of_order. A copy of the impugned order is attached as Annexure 'A'.

3. That the Petitioner has been prejudiced by the aforementioned order and has no alternative remedy available under law save through the exercise of the revisional jurisdiction of this Honourable Court.

4. That the lower Court erred in law by legal_error. This error is evident from the record and has occasioned a failure of justice.

5. That the lower Court's findings are nature_of_findings. The lower Court did not properly appreciate the evidence on record before arriving at its conclusion.

6. That procedural_defect, which is a serious procedural irregularity that vitiates the proceedings.

7. That the impugned order is perverse and not based on any reasonable view of the evidence. No reasonable Court could have arrived at such a finding.

8. That under Sections 435 and 439 CrPC, this Honourable Court has the power of revision and may call for the record of any case, examine it, and if it finds that an inferior court has committed an error of law or has occasioned a failure of justice, it may pass such order as it deems fit.

9. That this Honourable Court has territorial and pecuniary jurisdiction to entertain and decide the present petition.

PRAYER

It is, therefore, most respectfully prayed that this Honourable Court may be pleased to:

(a) Accept this criminal revision petition;

(b) Call for and examine the record of case_title, Case No. case_number, from the lower Court;

(c) Set aside the impugned order dated impugned_order_date, passed by lower_court_designation;

(d) consequential_prayer; and

(e) Grant such further and other relief as may be deemed just and proper in the circumstances of the case.
