DEED OF GIFT (HIBA)

THIS DEED OF GIFT made on deed_date

BETWEEN

donor_name, son/daughter of donor_father, resident of donor_address, CNIC No. donor_cnic (hereinafter called 'the DONOR' which term shall include his/her legal heirs, executors, administrators, and permitted assigns) OF THE ONE PART

AND

donee_name, son/daughter of donee_father, resident of donee_address, CNIC No. donee_cnic (hereinafter called 'the DONEE' which term shall include his/her legal heirs, executors, administrators, and permitted assigns) OF THE OTHER PART

WHEREAS

The Donor is the owner of the property hereinafter described and is desirous of making a gift (HIBA) of the said property to the Donee in accordance with Islamic law (Sharia) and the Transfer of Property Act 1882, and the Donee is willing to accept the same.

NOW THIS DEED WITNESSETH

OFFER OF GIFT (IJAB)

In consideration of the natural love and affection which the Donor has for the Donee, and the latter's relationship_to_donor, the Donor hereby, of his/her own free will and with clear intention, makes an unconditional offer to gift the property described above to the Donee. The Donor expressly declares that this gift is made gift_condition_clause and shall be gift_irrevocable_statement.

ACCEPTANCE OF GIFT (QABUL)

The Donee hereby accepts the gift offered by the Donor. The Donee acknowledges receipt of this offer and hereby declares acceptance thereof. The Donee further acknowledges that he/she is fully aware of the implications of accepting this gift under Islamic law.

DELIVERY AND POSSESSION (QABZA)

1. The Donor hereby delivers possession of the property to the Donee possession_mode. The Donee hereby takes physical possession of the property and assumes all rights and responsibilities thereof.

2. The Donor warrants that the property is free from all encumbrances, mortgages, charges, and liens, encumbrances_clause.

3. The Donor further warrants that he/she is the lawful and absolute owner of the property and has full power and authority to make this gift.

RIGHTS AND OBLIGATIONS

1. Upon acceptance and delivery of possession, the Donee shall acquire full ownership of the property, including all rights of use, enjoyment, and disposition.

2. The Donee shall be responsible for all outstandings from effective_date, including property taxes, utility bills, and municipal dues.

3. The Donor shall have donor_residual_rights_if_any in the property post-delivery.
