PETITION FOR FUNDAMENTAL RIGHTS UNDER ARTICLE 184(3) OF THE CONSTITUTION OF PAKISTAN 1973

Most respectfully submitted:

1. That the Petitioner files this petition in the larger public interest and in protection of fundamental rights guaranteed under Chapter 1 of Part II of the Constitution of Pakistan 1973, which constitute the founding principles of the Constitution.

2. That the Petitioner is petitioner_status directly affected by action_complained_of taken by the Respondents on date_of_action, which is in violation of the Petitioner's fundamental rights.

3. That the action complained of violates the Petitioner's right to fundamental_rights_violated guaranteed under Articles relevant_articles of the Constitution.

4. That the action taken by the Respondents is nature_of_action and has consequences. This action affects not only the Petitioner but also a wider class of persons, making it a matter of public importance.

5. That the circumstances of the case involve a substantial question regarding the interpretation and application of fundamental rights. The principles established in leading_cases are directly applicable to the present petition.

6. That the Respondents have not acted in accordance with law. The action taken is unlawful_because. There is no legal authority or constitutional provision that empowers the Respondents to take such action.

7. That the Petitioner has exhausted all available remedies before ordinary courts. remedies_tried. The relief sought is not available from any other forum, and hence the intervention of this Honourable Court under Article 184(3) is required.

8. That the matter involves a question of public importance and public interest necessitates the intervention of this Honourable Court. public_interest_statement.

9. That this Honourable Court has consistently held that where fundamental rights are at stake and a question of public importance is involved, the Court has a duty under Article 184(3) to exercise its extraordinary original jurisdiction.

10. That the Petitioner has filed this petition within the prescribed period and has disclosed all material facts. The evidence and documents submitted along with this petition establish the violation of fundamental rights and the irreparable harm caused.

PRAYER

It is, therefore, most respectfully prayed that this Honourable Court may be pleased to:

(a) Accept this petition as properly filed under Article 184(3) of the Constitution;

(b) Declare that the action of the Respondents is unlawful, unconstitutional, and in violation of the Petitioner's fundamental rights;

(c) Issue a writ of mandamus directing the Respondents to mandamus_relief;

(d) Issue a writ of prohibition restraining the Respondents from prohibition_relief;

(e) Award compensation to the Petitioner for the violation of fundamental rights and the loss suffered;

(f) Issue appropriate directions to make certain that the violation of fundamental rights is not repeated; and

(g) Pass such further or other order as this Honourable Court may deem just and proper in the circumstances of the case.
