PETITION FOR HABEAS CORPUS UNDER ARTICLE 184(3) OF THE CONSTITUTION OF PAKISTAN 1973
Most respectfully submitted:
1. That the Petitioner, through this petition, seeks the intervention of this Honourable Court to secure the liberty of detenu_name, who is being unlawfully detained by the Respondents in violation of the fundamental rights enshrined in the Constitution of Pakistan 1973.
2. That detenu_name is the detenu_relationship_to_petitioner of the Petitioner and has been in unlawful detention since detention_date at detention_location.
3. That the detention is without legal authority or justification. No formal charge has been levelled against the detenu, and no inquiry has been conducted in accordance with law.
4. That the detenu's right to life and liberty guaranteed under Article 9 of the Constitution is being violated. Additionally, the detention is in breach of Article 10 of the Constitution, which guarantees safeguards as to arrest and detention.
5. That despite repeated requests and written communications dated communication_dates, the Respondents have failed to produce the detenu before any judicial authority or to disclose the grounds of detention.
6. That the detention appears to be based on alleged_reason_for_detention, which does not constitute a valid ground for detention under Pakistani law.
7. That the Petitioner has no other remedy available except to invoke the original jurisdiction of this Honourable Court under Article 184(3) of the Constitution, which empowers the Court to grant relief in respect of fundamental rights violations.
8. That this case involves a question of public importance with reference to the enforcement of fundamental rights, making it appropriate for determination by this Honourable Court.
9. That the matter is one of extreme urgency, as continued detention in violation of fundamental rights causes irreparable harm to the detenu and the Petitioner.
10. That supporting documents including supporting_documents have been submitted along with this petition to establish the unlawful detention and the breach of constitutional rights.
PRAYER
It is, therefore, most respectfully prayed that this Honourable Court may be pleased to:
(a) Issue a writ of habeas corpus directing the Respondents to produce detenu_name before this Court;
(b) Declare the detention of detenu_name unlawful and in violation of Articles 9 and 10 of the Constitution;
(c) Order the immediate release of detenu_name from detention;
(d) Pass an order of costs against the Respondents; and
(e) Pass such further or other order as this Honourable Court may deem just and proper in the circumstances of the case.
