PETITION FOR PERMISSION TO CONTRACT SECOND MARRIAGE UNDER SECTION 6, MUSLIM FAMILY LAWS ORDINANCE 1961

APPLICATION FOR PERMISSION TO CONTRACT A SECOND MARRIAGE

1. The petitioner respectfully submits this application for permission to contract a second marriage in accordance with Section 6 of the Muslim Family Laws Ordinance 1961. 2. PETITIONER'S DETAILS: The petitioner, applicant_name, holder of CNIC No. applicant_cnic, is a Muslim male resident of applicant_address, aged applicant_age years, by profession applicant_profession, with monthly income of approximately PKR applicant_income. 3. EXISTING MARRIAGE: The petitioner is presently married to existing_wife_name, holder of CNIC No. existing_wife_cnic, resident of existing_wife_address, since existing_nikah_date. This marriage was solemnized at existing_nikah_place and registered under Registration No. existing_nikah_registration. 4. GROUNDS FOR SECOND MARRIAGE: The petitioner seeks permission for a second marriage on the following grounds: marriage_grounds 5. PARTICULARS OF PROPOSED SECOND WIFE: The petitioner seeks to marry proposed_wife_name, holder of CNIC No. proposed_wife_cnic, age proposed_wife_age, resident of proposed_wife_address, daughter of proposed_wife_father, on the basis of mutual consent and with the intention of a valid and permanent marriage. 6. CONSENT OF EXISTING WIFE: consent_status. consent_details. 7. FINANCIAL CAPACITY: The petitioner has the financial capacity to maintain both wives in accordance with Section 6(4) of the Muslim Family Laws Ordinance 1961. The petitioner's monthly income is PKR applicant_income, and monthly expenses are approximately PKR monthly_expenses, leaving a surplus of PKR surplus sufficient to maintain a second wife at the standard of living enjoyed by the existing wife. 8. PROPERTY AND ASSETS: The petitioner owns the following immovable property: property_details 9. FAIR AND EQUITABLE TREATMENT: The petitioner gives the undertaking that both wives shall be treated equitably and fairly in all matters including maintenance (nafaqah), accommodation, clothing, and conjugal rights, as required under Islamic principles and Section 6(3) of the Muslim Family Laws Ordinance 1961. 10. ABSENCE OF INJUSTICE: The proposed second marriage shall not cause injustice to the existing wife, nor violate the terms of any existing marriage contract (nikah nama). 11. The petitioner is fully cognizant of his obligations under Islamic law and the Muslim Family Laws Ordinance 1961 and submits that all conditions prescribed thereunder are satisfied.

WHEREFORE, the petitioner respectfully prays that this Honourable Council may be pleased to: (1) Admit this petition for permission to contract a second marriage; (2) Grant the petitioner written permission to contract marriage with proposed_wife_name in accordance with Section 6 of the Muslim Family Laws Ordinance 1961; (3) Direct the Nikah Registrar to register the second marriage upon solemnization; (4) Record the petitioner's undertaking to maintain both wives equitably; (5) Record the consent of the existing wife to the second marriage; and (6) Afford such further and other relief as this Honourable Council may deem fit and proper.

PRAYER

It is, therefore, most respectfully prayed that may be pleased to:

(a) Grant permission to the Applicant to contract a second marriage during the subsistence of the existing marriage with existing_wife_name, in terms of Section 6 of the Muslim Family Laws Ordinance 1961;

(b) Specify any reasonable conditions that the Arbitration Council may consider necessary in the interest of the existing wife and minor children;

(c) Direct that the Applicant continue to provide adequate maintenance, accommodation, and rights to the existing wife and the children of the existing marriage notwithstanding the second marriage;

(d) Issue a written certificate of permission to the Applicant for production before the Nikah Registrar; and

(e) Pass any other or further order that the Arbitration Council may consider just and proper in the circumstances.
