TRANSFER PETITION UNDER ARTICLE 187 OF THE CONSTITUTION OF PAKISTAN 1973 AND ORDER XXXIII OF THE SUPREME COURT RULES 1980
Most respectfully submitted:
1. That the Petitioner seeks transfer of the case case_reference_in_original_court pending before the original_court_name at original_court_location to proposed_transferee_court for the reasons set out herein.
2. That the original_court_name granted a decree/passed an order dated original_decision_date in favour of the Petitioner. Against this decision, the Respondent has preferred an appeal/filed proceedings in the other_high_court_name at other_high_court_location.
3. That a substantially similar case involving the same parties and the same subject matter is pending in proposed_transferee_court, under case reference case_in_proposed_court. This parallel litigation creates jurisdictional conflict and the potential for conflicting judgments on identical issues of law and fact.
4. That the facts of both cases arise from the same transaction or occurrence dated transaction_date. Both cases relate to subject_matter and involve substantially identical issues of legal_issue.
5. That the Petitioner obtained a decree from original_court_name in original_case_reference dated decree_date, and this decree remains in force. The commencement of parallel proceedings in other_high_court_name by the same Respondent creates the prospect of the other_high_court_name reaching a decision contrary to the settled decree already passed.
6. That the continuation of these parallel proceedings in two different High Courts is not only inconvenient and wasteful of judicial resources but also contrary to the principles of comity between judicial forums and the interests of justice.
7. That transfer to a single forum will promote judicial efficiency, avoid duplication of effort, and ensure consistency in the application of law. The court in proposed_transferee_court is better positioned to adjudicate both matters in a consolidated manner.
8. That the Petitioner has adopted the course of seeking transfer rather than approaching the High Courts separately, thereby demonstrating good faith and respect for judicial authority.
9. That the Petitioner has a genuine concern regarding the administration of justice being served. The transfer is not being sought for any collateral or extraneous purpose but solely to make certain that identical_legal_questions are decided consistently by a single forum.
10. That this Honourable Court, under Article 187 of the Constitution read with Order XXXIII of the Supreme Court Rules 1980, possesses the incidental jurisdiction to transfer cases between High Courts in the interests of justice and to ensure coordination between judicial forums.
PRAYER
It is, therefore, most respectfully prayed that this Honourable Court may be pleased to:
(a) Allow this transfer petition and order the transfer of case case_reference_in_original_court from original_court_name to proposed_transferee_court;
(b) Alternatively, order the consolidation of the parallel proceedings pending in both High Courts before a single bench to be constituted by the Chief Justice;
(c) Issue appropriate directions to the original_court_name and the other_high_court_name to ensure no conflicting orders are passed pending the transfer;
(d) Award costs of this petition; and
(e) Pass such further or other order as this Honourable Court may deem just and proper in the circumstances of the case.
