Can I disinherit a family member in Pakistan?
No. Under Islamic law, you cannot alter the fixed inheritance shares. You cannot disinherit a legal heir. A will (wasiyyat) can only dispose of up to 1/3 of the estate and cannot be made in favour of a person who is already an heir.
What is a Succession Certificate and when do I need one?
A Succession Certificate is a court-issued document that authorises heirs to collect the deceased's bank balances, shares, insurance, and other financial assets. You need it whenever banks or institutions require proof of your legal right to the deceased's assets.
How do I get my inheritance share if my siblings refuse?
File a suit for declaration (to establish your right) and partition (to divide the property) in the Civil Court. You can also approach the Punjab Women's Property Rights Ombudsperson if you are a woman denied inheritance in Punjab.
