APPEAL AGAINST ORDER/JUDGMENT OF BANKING COURT UNDER SECTION 22 FIRO 2001

Respectfully sheweth:

1. That this appeal is filed by the Appellant against the judgment and decree dated banking_court_judgment_date passed by the learned Banking Court, banking_court_city, in Banking Suit No. banking_suit_no of banking_suit_year, whereby the Appellant was ordered to pay a sum of Rs. decreed_amount.

2. That the said judgment is erroneous in law and fact, and the Banking Court failed to properly appreciate the evidence on record and the applicable law.

5. That the Appellant is aggrieved by the judgment and submits that grounds_of_appeal.

9. That the Banking Court erred in its application of the law and the jurisprudence governing financial institutions.

10. That questions of law and fact arise from the judgment of the Banking Court, and this appeal is properly maintainable before this Honourable High Court under Section 22 FIRO 2001.

11. That the Appellant has preferred this appeal within the period of limitation prescribed under Section 22 FIRO 2001, that is, within thirty days of the judgment of the Banking Court.

12. That the impugned judgment requires to be set aside and the appeal should be allowed.

PRAYER

It is, therefore, most respectfully prayed that this Honourable Court may be pleased to:

(a) Allow this appeal;

(b) Set aside the judgment and decree passed by the Banking Court dated banking_court_judgment_date;

(c) Pass such judgment and decree as is deemed just and proper appellant_relief_sought; or

(d) Remit the case to the Banking Court for fresh consideration on the point of law if_applicable;

(e) Award costs to the Appellant; and

(f) Pass any such further or other order as deemed just and proper in the circumstances of the case.
