EMPLOYMENT CONTRACT
This Employment Contract is made on contract_date at place_of_execution
BETWEEN: employer_name, a company / firm / organisation incorporated / registered under the laws of Pakistan, having its registered office at employer_address, through its authorised representative employer_signatory (hereinafter referred to as "the Employer") AND employee_name, son/daughter of employee_father, aged about employee_age years, resident of employee_address, holder of CNIC No. employee_cnic (hereinafter referred to as "the Employee")
WHEREAS
WHEREAS the Employer is engaged in the business of employer_business and desires to employ the Employee in the position of employee_designation; and WHEREAS the Employee has represented to the Employer that he / she possesses the qualifications, experience, and skills required for the said position and is willing to accept employment on the terms and conditions set out below; NOW, THEREFORE, the parties hereby agree as follows.
1. APPOINTMENT AND DESIGNATION: The Employer hereby appoints the Employee as employee_designation, reporting to reporting_to, with effect from effective_date. The Employee accepts the said appointment subject to the terms and conditions set out herein.
2. DUTIES AND RESPONSIBILITIES: The Employee shall faithfully and diligently discharge the duties and responsibilities described in Schedule A annexed hereto, including primary_duties, and shall devote his / her whole time, attention, and abilities to the business of the Employer during the working hours specified.
3. PROBATIONARY PERIOD: The Employee shall be on probation for a period of probation_months months from the effective date. During the probationary period, either party may terminate the employment by giving fifteen days' notice in writing without assigning any reason. On successful completion of the probation, the appointment shall be confirmed in writing.
4. PLACE OF WORK: The Employee shall be based at place_of_work but may be required to travel to or be transferred to any other office, branch, or location of the Employer in Pakistan or abroad as the Employer's business may reasonably require.
5. WORKING HOURS: The Employee shall work for the standard working hours of working_hours per day from work_days, with a break_period break, in accordance with the Employer's working hours policy. Reasonable additional hours required for the proper discharge of duties shall be undertaken without additional remuneration.
6. REMUNERATION: The Employer shall pay the Employee a gross monthly salary of Rs. gross_salary, comprising basic salary of Rs. basic_salary, house rent allowance of Rs. hra, conveyance allowance of Rs. conveyance, utility allowance of Rs. utility, and other allowances of Rs. other_allowances. The salary shall be paid in arrears on or before the salary_payment_date day of each succeeding month, by bank transfer to the Employee's designated bank account.
7. INCOME TAX AND DEDUCTIONS: The Employer shall deduct income tax at source under Section 149 of the Income Tax Ordinance 2001 and other statutory deductions including EOBI, social security, and provident fund contributions in accordance with applicable law. The Employee shall be solely responsible for any additional tax liability.
8. ANNUAL INCREMENT AND BONUS: The Employer shall consider an annual increment of annual_increment per cent on the basic salary subject to satisfactory performance, payable from increment_anniversary of each year. The Employee shall also be eligible for an annual bonus of annual_bonus months of basic salary, subject to the Employee being in service on the date of declaration.
9. BENEFITS: The Employee shall be entitled to the following benefits during the term of employment: (a) annual leave of annual_leave_days working days; (b) casual leave of casual_leave_days working days; (c) sick leave of sick_leave_days working days; (d) medical reimbursement up to Rs. medical_cap per annum; (e) life and health insurance coverage as per the Employer's group policy; (f) provident fund contribution as per the Employer's policy; (g) gratuity as per the Standing Orders Ordinance 1968 / Employer's policy; and (h) such other benefits as the Employer may from time to time provide to similarly placed employees.
10. CONFIDENTIALITY: The Employee shall, during the term of employment and at all times thereafter, maintain in strict confidence all confidential information, trade secrets, business plans, customer lists, financial data, technical information, and proprietary information of the Employer ("Confidential Information"), and shall not disclose, use, or exploit such Confidential Information except for the proper performance of the Employee's duties.
11. INTELLECTUAL PROPERTY: All inventions, designs, computer programs, copyright works, trademarks, trade secrets, and any other intellectual property rights created by the Employee in the course of or in connection with the employment shall vest absolutely in the Employer. The Employee hereby assigns all such intellectual property rights to the Employer and undertakes to execute any documents necessary to give effect to such assignment.
12. NON-COMPETE AND NON-SOLICITATION: During the term of employment and for a period of non_compete_months months thereafter, the Employee shall not, within non_compete_territory, directly or indirectly engage in or be associated with any business that competes with the Employer's business, nor shall the Employee solicit any customer, supplier, or employee of the Employer to terminate or alter the relationship with the Employer.
13. CODE OF CONDUCT: The Employee shall at all times comply with the Employer's code of conduct, anti-bribery and anti-corruption policy, equal opportunity policy, harassment policy, and other policies and procedures as may be issued from time to time. Any breach of these policies may result in disciplinary action including termination.
14. TERMINATION: This contract may be terminated by either party on the following grounds and in the following manner: (a) by the Employer for cause (misconduct, inefficiency, breach of contract, criminal conduct) following inquiry under the Standing Orders Ordinance 1968 with immediate effect; (b) by either party without cause on notice_period_days days' notice in writing or salary in lieu thereof; (c) automatically on the Employee attaining superannuation age of retirement_age years; (d) by mutual agreement in writing; or (e) on permanent disability or death of the Employee.
15. RETURN OF PROPERTY: On termination of employment for any reason, the Employee shall forthwith return to the Employer all property, documents, records, equipment, and Confidential Information in his / her possession, and shall not retain any copy thereof.
16. FINAL SETTLEMENT: On termination, the Employer shall pay to the Employee, within thirty days, all wages and benefits accrued up to the date of termination, accumulated leave encashment (where applicable), gratuity, provident fund, and any other amount due, after deducting any sums owed by the Employee to the Employer.
17. DISPUTE RESOLUTION: Any dispute arising out of or in connection with this contract shall first be attempted to be resolved through good-faith negotiation between the parties. Failing such resolution, the dispute shall be referred to arbitration under the Arbitration Act 1940 by a sole arbitrator at arbitration_seat in English. The decision of the arbitrator shall be final and binding.
18. GOVERNING LAW AND JURISDICTION: This contract shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Subject to the arbitration clause, the courts at jurisdiction_city shall have exclusive jurisdiction.
19. ENTIRE AGREEMENT: This contract, together with the Schedules annexed, constitutes the entire agreement between the parties regarding the Employee's employment and supersedes all prior agreements, understandings, or representations, whether oral or written.
20. AMENDMENT AND WAIVER: No amendment to this contract shall be effective unless made in writing and signed by both parties. No waiver of any breach shall constitute a waiver of any subsequent breach.
