APPEAL AGAINST MUTATION ORDER UNDER SECTION 161-A, PUNJAB LAND REVENUE ACT 1967
1. This appeal is filed against the mutation order dated mutation_order_date, passed by lower_authority_title, lower_authority_name, in mutation No. mutation_number, whereby mutation_order_summary.
2. That the appellant is appellant_status of the impugned property, and has a direct interest in the mutation proceedings.
3. That the impugned mutation order was passed in violation of legal_violation, and without considering the appellant's legitimate objections.
4. That the mutation was sought to be registered in the name of new_entry_holder on the basis of claimed_basis_of_mutation, without proper missing_documentation.
5. That the title deeds and supporting documents filed with the mutation application were document_status, and contained document_deficiencies.
6. That the appellant timely filed written objections to the mutation on objection_date, on the grounds that objection_grounds.
7. That the lower authority error_of_procedure, without affording proper opportunity to the appellant to be heard on the substantive objections.
8. That the appellant's position is supported by supporting_evidence, which establishes that appellant_substantive_claim.
9. That the entry effected through the impugned mutation is legal_consequence, and has caused harm_to_appellant.
10. That Section 161-A of the Punjab Land Revenue Act 1967 confers jurisdiction on the Collector to entertain appeals against mutation orders passed by the Patwari or other_lower_authority, within a period of thirty days from the date of the order.
11. That the present appeal is being filed within the statutory limitation of thirty days from mutation_order_date, and is therefore within the time permitted under law.
12. That the findings of the lower authority are appellable_error, based on misreading of the documents and disregard for established revenue law principles.
PRAYER
It is, therefore, prayed that this Honourable Collector may be pleased to:
(a) Accept this appeal and set aside the mutation order dated mutation_order_date, passed by lower_authority_title, lower_authority_name;
(b) Direct reversion of the mutation entry to the original state of affairs existing prior to mutation_number;
(c) Direct lower_authority_title to proceed afresh on the mutation application, giving due consideration to all objections raised by the appellant;
(d) Pass such orders as are necessary to rectify the revenue record and restore the appellant's rights over khasra_number; and
(e) Grant such other and further relief as this Honourable Collector may deem just and proper in the circumstances.
