Domestic and foreign arbitration applications under the Arbitration Act 1940 and the Recognition and Enforcement (Arbitration Agreements and Foreign Arbitral Awards) Act 2011.
Arbitration in Pakistan is governed by two parallel regimes: the Arbitration Act 1940 for domestic arbitration and the Recognition and Enforcement (Arbitration Agreements and Foreign Arbitral Awards) Act 2011 (REAAA) for foreign-seated and New York Convention arbitrations. The 1940 Act provides for the appointment of arbitrators (Section 8), the filing of awards in court (Section 14), challenge proceedings (Section 30), and enforcement (Section 17). The library covers applications for appointment of arbitrator, applications for stay of suit under Section 34 (in favour of arbitration), applications for filing of award, objections to award, applications for recognition and enforcement of foreign awards under REAAA, and procedural motions in arbitral proceedings.
