Sub-Registrar / Auqaf · Pakistan Waqf Properties Ordinance 1979 read with Muhammadan Law
Constitutional petitions under Article 199 before the High Courts and Article 184(3) before the Supreme Court for enforcement of fundamental rights.
The constitutional remedy in Pakistan is invoked under Article 199 of the Constitution of the Islamic Republic of Pakistan 1973 before the five High Courts (Lahore, Sindh, Peshawar, Balochistan, Islamabad) and under Article 184(3) before the Supreme Court of Pakistan. The High Courts exercise constitutional jurisdiction in the four classical writs — mandamus, prohibition, certiorari, quo warranto — and a residuary jurisdiction in matters where no equally efficacious alternative remedy is available. The library covers writ petitions of every kind: against public authorities, against private bodies performing public functions, FST petitions, service tribunal petitions for civil servants, petitions under Article 199(1)(a)(i), (ii), (iii), (b)(i), (b)(ii), and (c), and constitutional petitions before the Federal Shariat Court under Article 203D for laws repugnant to the Injunctions of Islam.
