LEGAL NOTICE FOR DISHONOUR OF BILL OF EXCHANGE AND DEMAND FOR PAYMENT
Sir/Madam,
1. This notice is issued on behalf of creditor_name, CNIC No. creditor_cnic, resident of creditor_address (hereinafter referred to as the "Holder"), against accused_name, CNIC No. accused_cnic, resident of accused_address (hereinafter referred to as the "Acceptor/Drawer"), for the dishonour of a bill of exchange and demand for immediate payment of the amount due thereon. The Acceptor's dishonour of the bill constitutes a serious violation of commercial law, statutory obligations, and the law of contract, and entitles the Holder to pursue legal remedies against the Acceptor.
2. A bill of exchange was duly drawn by drawer_name on bill_date for an amount of PKR bill_amount, payable to the order of the Holder or bearer_or_order. The bill was made payable bill_maturity_terms at place_of_payment, specifically on or before maturity_date. bill_details. The bill is a valid and enforceable negotiable instrument under the Negotiable Instruments Act 1881.
3. The bill of exchange was duly accepted by the Acceptor on acceptance_date at place_of_acceptance, thereby creating a binding legal obligation and an unconditional promise to pay the specified sum of PKR bill_amount on the due date. The acceptance constituted an absolute commitment to honor the bill upon presentation. The Acceptor's signature is affixed on the bill itself.
4. On maturity_date, the bill was presented for payment at place_of_presentation through bank_or_person_presented, in accordance with the Negotiable Instruments Act 1881. The bill was presented in time and in the proper manner. However, the bill was dishonoured on the stated ground that reason_for_dishonour. A formal dishonour notice was issued and served on notice_date, marking the bill as dishonoured.
5. The dishonour of the bill of exchange constitutes a grave violation of the statutory obligations imposed by the Negotiable Instruments Act 1881. Under Section 91 of the said Act, a bill of exchange is dishonoured when it is not accepted by the drawee or when it is not paid upon presentation at maturity. Such dishonour by a party to the bill entitles all other parties to pursue legal remedies including claims for damages and recovery of the bill amount.
6. Under Section 93 of the Negotiable Instruments Act 1881, notice of dishonour must be given to prior parties to the bill (drawer and endorsers) to charge them and preserve their liability. This notice serves to preserve the Holder's rights against all prior parties. The Holder hereby gives formal notice of dishonour to the Acceptor and all other parties to the bill. notice_implications.
7. The Acceptor's refusal to honor the bill is wholly unjustified and unfounded. justification_of_claim. The Acceptor has received the goods/services for which the bill was issued and has derived full benefit therefrom. The Acceptor has no valid defense or counterclaim. The Acceptor's conduct is a deliberate repudiation of a clear and unambiguous contractual obligation.
8. The Acceptor's conduct constitutes a violation of: (a) the contract between the parties as evidenced by the bill of exchange and the underlying commercial transaction; (b) the statutory obligations under the Negotiable Instruments Act 1881 which governs bills of exchange and negotiable instruments in Pakistan; and (c) general principles of commercial law, mercantile custom, and good faith in commercial transactions.
9. As a consequence of this dishonour, the Holder has suffered considerable financial loss and damage to credit and reputation in the commercial and business community. consequential_loss. The Holder has been forced to remedial_steps_taken. The Holder's business relationships have been strained and the Holder's credit rating has been affected.
10. The Holder hereby makes a final demand for payment of the following amounts within payment_deadline days from the date of receipt of this notice: (a) the full bill amount of PKR bill_amount; (b) interest on the dishonoured bill at interest_rate per annum from maturity_date till date of actual payment; (c) charges and costs incurred by the Holder in pursuing this claim including counsel fees of PKR counsel_fees; and (d) damages for breach of contract and dishonour in the sum of damages_amount.
11. The Holder reserves the right to pursue all legal remedies available under the Negotiable Instruments Act 1881, the Contract Act 1872, and the general law of tort. This includes: (a) filing a comprehensive suit before the competent court for recovery of the bill amount with interest at interest_rate per annum and all costs; (b) pursuing criminal proceedings under the Cheque Dishonour Act (if a cheque is involved) or under Section relevant_criminal_section of the Pakistan Penal Code; (c) seeking dishonour damages; and (d) pursuing all civil and criminal remedies available to protect the Holder's rights.
Provide written confirmation of payment within payment_deadline days. Payment should be made to payment_instructions. Failure to make payment will result in civil and criminal proceedings being initiated immediately without further notice or opportunity.
