WITHOUT PREJUDICE
Dear cheque_drawer_name,
1. This legal notice is issued on behalf of client_name, son/daughter of client_father, resident of client_address (hereinafter referred to as 'my client'), in relation to a cheque bearing No. cheque_number drawn on drawee_bank_name, bank_branch_name branch, dated cheque_date.
2. You issued the aforesaid cheque in favour of my client for a sum of Rs. cheque_amount_words (Rs. cheque_amount_figures) as payment of purpose_of_cheque.
3. My client deposited the cheque in his / her bank account on cheque_deposit_date.
4. The cheque was presented for clearing to the drawee bank, drawee_bank_name, on cheque_presentation_date.
5. The cheque has been dishonoured by the drawee bank on cheque_dishonour_date with the following memo: dishonour_memo.
6. My client has served the statutory notice on you as required by Section 138 of the Negotiable Instruments Act 1881, and a copy of the memo from the drawee bank is attached hereto.
7. Despite the aforesaid notice, you have failed to make payment of the cheque amount to my client within the statutory period of 30 days, thereby constituting a criminal offence under Section 489-F Pakistan Penal Code 1860.
8. Your action amounts to criminal breach of trust and dishonesty in financial dealings.
TAKE NOTICE that my client intends to initiate a private complaint before the Magistrate under Section 489-F Pakistan Penal Code 1860 against you for the offence of cheque dishonour. My client reserves the right to claim full compensation including interest, cost of recovery proceedings, and any other relief available under law.
It is, therefore, in your own interest to make immediate payment of Rs. cheque_amount_figures to my client within notice_period_days days of receipt of this notice, failing which my client shall pursue all available legal remedies.
