LEGAL NOTICE FOR TRADEMARK INFRINGEMENT AND PASSING OFF
Sir/Madam,
1. This notice is issued on behalf of trademark_owner_name, CNIC No. owner_cnic, resident of trademark_owner_address (hereinafter referred to as the "Proprietor"), to formally inform you that you are committing a flagrant and deliberate violation of the intellectual property rights of the Proprietor by unauthorizedly using, manufacturing, marketing, and distributing goods bearing the Proprietor's registered trademark without permission, license, or authority. This notice demands your immediate cessation of all infringing activities and withdrawal of all counterfeit and infringing goods from commerce.
2. The Proprietor is the registered proprietor of the trademark "trademark_text" bearing Registration No. trademark_registration_number, Class trademark_class, registered on registration_date with the Intellectual Property Organization of Pakistan (IPO-Pakistan). The Proprietor's trademark is duly published in the Official Gazette and has been continuously used, exploited, and maintained since date_of_first_use for the goods and services falling within the category of goods_or_services_covered. The registration is valid and subsisting and has not been subject to any cancellation or limitation.
3. The Proprietor's trademark has acquired considerable goodwill, reputation, and commercial value in the marketplace over the period of years_of_use years. The trademark is recognized and associated by the consuming public with product_quality manufactured, produced, or supplied by the Proprietor. The Proprietor has expended substantial funds in advertising and promoting the said trademark. The trademark carries significant commercial goodwill that is the result of the Proprietor's efforts and investment.
4. It has come to the Proprietor's notice that you are, without any authorization, consent, or license from the Proprietor, using an identical or confusingly similar mark "infringing_mark" on infringing_goods_or_services. Your unauthorized use commenced on or about date_of_commencement_of_infringement and has continued till date. You are manufacturing, marketing, selling, and distributing goods bearing the said infringing mark to unsuspecting consumers distribution_channels.

5. Your use of the said infringing mark is clearly calculated to and has the effect of: (a) deceiving and misleading consumers into believing that the goods or services bearing your mark are authentic, genuine, and manufactured or provided by the Proprietor; (b) taking unfair and unlawful advantage of the goodwill, reputation, and commercial value of the Proprietor's trademark; (c) causing dilution, degradation, and tarnishment of the Proprietor's trademark; and (d) unjustly enriching yourself at the direct expense of the Proprietor.
6. Your conduct constitutes trademark infringement within the meaning of Section 46 of the Trade Marks Ordinance 2001. Section 46(1) explicitly provides that infringement occurs when an unauthorized person uses a mark identical with or likely to be confused with a registered mark in relation to goods or services for which the mark is registered. Your mark is similarity_degree similar to the Proprietor's registered trademark, and the goods/services are goods_similarity_degree similar, thereby creating a likelihood of confusion among consumers.
7. Your conduct also constitutes the common law tort of passing off. You are falsely representing your goods or services as being those of the Proprietor or as being authorized by the Proprietor. This misrepresentation is deliberate and calculated to deceive the public. You are thereby appropriating the Proprietor's reputation and goodwill for your commercial gain. The tort of passing off is actionable and entitles the Proprietor to seek equitable relief including injunctive relief and damages.
8. As a result of your infringing acts, the Proprietor has suffered significant loss and damage. loss_and_damage_details. The Proprietor's legitimate sales have been diverted to you due to the confusion created by your infringing mark. The Proprietor's reputation has been damaged due to inferior quality or defective goods being supplied by you under the Proprietor's trademark. The Proprietor's brand equity has been diluted due to your unauthorized use.
9. You are hereby required to take immediate and unconditional action as follows within seven days from the date of receipt of this notice: (a) immediately cease and desist from using, manufacturing, marketing, and distributing any goods or services bearing the mark "infringing_mark" or any mark deceptively similar thereto; (b) immediately withdraw all goods bearing the infringing mark from all retail outlets, warehouses, distributors, and points of sale; (c) destroy all stocks, inventory, materials, packaging, labels, and advertisements bearing the infringing mark; (d) cease all advertising and promotional activities; (e) provide written confirmation of compliance.
10. The Proprietor further demands compensation for the loss and damages suffered as a result of your infringing activities. The Proprietor claims compensation of PKR compensation_amount comprising lost profits, damage to reputation, costs of litigation, and punitive damages for the willful and deliberate nature of your infringement.
11. In the event of your non-compliance with this notice within the stipulated period, the Proprietor reserves the right to pursue all legal remedies available under law without any further notice or communication. These include: (a) filing a comprehensive suit before the competent court seeking mandatory and prohibitory injunctive relief, damages, and accounts of profits; (b) seeking an order for destruction of all infringing goods and materials at your cost; (c) filing a complaint with the Intellectual Property Organization of Pakistan requesting cancellation or suspension of any registrations obtained by you; (d) pursuing criminal proceedings under the Trade Marks Ordinance 2001 for criminal infringement and counterfeiting; and (e) pursuing all civil remedies for unjust enrichment, conversion, and tort.
Acknowledge receipt of this notice within two days. You are required to provide a written response within seven days confirming strict compliance with all demands and immediate cessation of all infringing activities. Continued infringement will result in immediate legal proceedings without further notice.
