LEGAL NOTICE FOR RECOVERY OF RENT ARREARS AND TERMINATION OF TENANCY

Sir/Madam,

1. This notice is issued on behalf of landlord_name, CNIC No. landlord_cnic, resident of landlord_address (hereinafter referred to as the "Landlord"), as the absolute owner and lessor of the premises situated at property_address, comprising property_description (hereinafter referred to as the "Property"). The Landlord is serving this formal notice upon tenant_name, CNIC No. tenant_cnic, resident of tenant_address (hereinafter referred to as the "Tenant"), to recover the outstanding and arrear rent and to terminate the tenancy with immediate effect.

2. The Property was let to the Tenant by the Landlord under a lease agreement dated lease_agreement_date, for an agreed monthly rent of PKR monthly_rent. lease_terms. The tenancy was constituted on a tenancy_type basis with effect from commencement_date and has been continuing since that date. The rent was due and payable on rent_payment_date of each month/payment_schedule.

3. The Tenant has willfully and deliberately defaulted in payment of rent and has persistently failed to discharge his statutory and contractual obligations as a tenant. As on the date of this notice notice_date, the Tenant owes an outstanding amount of PKR total_arrears representing months_of_arrears months of unpaid rent. Detailed arrears breakup is as follows: rent_arrears_detail This amount is now due and immediately payable by the Tenant to the Landlord.

4. Despite multiple previous reminders and notices issued on previous_reminder_dates, and despite number_of_personal_demands personal demands made by the Landlord or his agents on dates_of_personal_demands, the Tenant has stubbornly refused and failed to make any payment whatsoever towards the outstanding rent. The Tenant's conduct in defaulting on rent payment constitutes a gross and material violation of the terms of the lease agreement and the statutory obligations imposed by the Transfer of Property Act 1882.

5. Under Section 106 of the Transfer of Property Act 1882, a lessor is legally entitled to terminate a lease by serving notice on the lessee requiring him to vacate the property. Section 106 further provides that the period of notice depends on the nature and duration of the tenancy. For a tenancy_type tenancy, notice of notice_period_requirement is required ending with the tenancy_period. The Tenant's material default in payment of rent constitutes sufficient grounds for termination.

6. The Tenant's default in payment of rent is a material breach of the lease agreement and a violation of statutory rights. This default gives the Landlord the absolute right to recover possession of the premises and pursue legal proceedings for recovery of all arrears. The Tenant's continued occupation without payment is illegal and amounts to a trespass after termination.

7. The Tenant is hereby required to clear all outstanding rent arrears of PKR total_arrears in full within notice_period days from the date of receipt of this notice. Payment must be made in the following manner: payment_details. If payment is made in installments, the following schedule is imposed: installment_schedule. Failure to make payment in the prescribed manner will be treated as non-compliance.

8. Furthermore, the Tenant is hereby given formal notice of termination of the tenancy of the Property with effect from termination_date. The Tenant is required to vacate the Property completely and hand over vacant and peaceful possession to the Landlord by the said date. All fixtures, improvements, and additions made by the Tenant shall become the property of the Landlord.

9. In the event of the Tenant's failure to: (a) clear the outstanding rent arrears of PKR total_arrears within the stipulated period, OR (b) vacate the Property and deliver vacant and peaceful possession by termination_date, the Landlord shall be entitled to pursue all legal remedies available under the Transfer of Property Act 1882, the Rented Premises Ordinance of relevant_province, and the law of tort. These remedies include: (a) filing an ejectment suit before the competent court for recovery of possession on the ground of default in rent payment; (b) filing a suit for recovery of all outstanding rent arrears with interest at interest_rate per annum; (c) obtaining a decree for eviction and recovery of arrears with interest and full costs; and (d) taking possession of the Property and re-letting it at the Tenant's risk and cost.

10. The Tenant is further cautioned that any damage to the Property, fixtures, or fittings caused by the Tenant or his household will be recovered from the security deposit or pursued as a separate claim. The Tenant is responsible for returning the Property in the same condition as it was at the time of taking possession, normal wear and tear excepted.

11. The Tenant is required to respond to this notice within response_period days of receipt and confirm his compliance with the demands herein. All communications regarding this matter should be directed to counsel_contact.

Acknowledge receipt of this notice within two days. You must provide a written response within response_period days confirming: (i) full payment of outstanding rent arrears, or (ii) a binding schedule for payment, and (iii) your intention to vacate the Property by termination_date. Failure to comply will result in ejectment proceedings being initiated immediately without further notice.
