PLAINT FOR DECLARATION OF TITLE WITH CONSEQUENTIAL RELIEFS UNDER SECTION 42 OF THE SPECIFIC RELIEF ACT 1877
Suit valuation for the purposes of court fee and jurisdiction: Rs. suit_valuation. Court fee paid: Rs. court_fee_paid affixed on the plaint.
Respectfully sheweth:
1. That the Plaintiff is the lawful, sole, and absolute owner of the immovable property described in detail in paragraph 2 below, hereinafter referred to as "the suit property", and is entitled to a declaration of title in respect thereof under Section 42 of the Specific Relief Act 1877.
2. DESCRIPTION OF THE SUIT PROPERTY: The suit property is more particularly described as follows. property_description. Total measured area: total_area. Location: property_location. Boundaries: North: boundary_north; South: boundary_south; East: boundary_east; West: boundary_west. Estimated current market value: Rs. market_value.
3. REVENUE PARTICULARS: The suit property is recorded in the revenue record as Khewat No. khewat, Khatooni No. khatooni, Khasra No. khasra_numbers, Mauza / Mohalla mauza, Tehsil tehsil, District district. The current Fard / Jamabandi entries reflecting the Plaintiff's ownership are annexed.
4. SOURCE OF TITLE: The Plaintiff acquired title to the suit property by way of mode_of_acquisition on acquisition_date, by virtue of title_document_description, registered as registration_particulars. A certified copy of the said title document is annexed and marked as Exhibit P-1.
5. MUTATION HISTORY: Pursuant to acquisition of title, mutation No. mutation_number, dated mutation_date, was duly attested in favour of the Plaintiff and the Plaintiff's name was entered in the relevant column of ownership in the revenue record. Subsequent revenue entries, including agricultural and water rate registers, continue to reflect the Plaintiff as owner.
6. POSSESSION: The Plaintiff has been in continuous, peaceful, and exclusive possession of the suit property since the date of acquisition, openly exercising acts of ownership including acts_of_ownership. The possession of the Plaintiff has at no time been challenged or interrupted by any person whomsoever, save by the unlawful conduct of the Defendants described below.
7. CLOUD ON TITLE BY DEFENDANTS: On adverse_conduct_date, the Defendants, without lawful authority or any pre-existing right, asserted a contrary claim to the suit property by defendants_adverse_conduct. The Defendants have either obtained or attempted to obtain adverse_documentation in respect of the suit property, which is fictitious, fraudulent, and not binding on the Plaintiff.
8. INVESTIGATION OF ADVERSE CLAIM: On enquiry, the Plaintiff has discovered that the document or claim relied upon by the Defendants suffers from the following defects: defects_in_adverse_claim, rendering it void ab initio and incapable of conferring any right, title, or interest on the Defendants.
9. NOTICE TO DEFENDANTS: A formal written notice was served by the Plaintiff on the Defendants through registered post on notice_date, calling upon the Defendants to withdraw their adverse claim and to refrain from any further interference with the Plaintiff's title and possession. The Defendants either failed to respond or, having responded, persisted with their adverse claim. notice_response.
10. APPREHENSION OF DISPOSSESSION: The conduct of the Defendants gives rise to a real and imminent apprehension that the Plaintiff may be dispossessed of the suit property unless the relief prayed for is granted. The Plaintiff has therefore approached this Honourable Court at the earliest opportunity to safeguard its lawful title.
11. CONSEQUENTIAL RELIEFS: As a consequence of the declaration prayed for, the Plaintiff is entitled to a permanent injunction restraining the Defendants from interfering with the Plaintiff's title and possession, and to cancellation of any sham document obtained by the Defendants in respect of the suit property.
12. NO ALTERNATIVE FURTHER RELIEF: The Plaintiff, save for the consequential reliefs prayed for herein, is not entitled to any further relief in respect of the subject-matter, and accordingly the bar contained in the proviso to Section 42 of the Specific Relief Act 1877 is not attracted to the present suit.
13. JURISDICTION: This Honourable Court has territorial and pecuniary jurisdiction to entertain the present suit, the suit property being situated wholly within the territorial limits of this Court, and the value of the suit for the purposes of court fee and jurisdiction being within the pecuniary jurisdiction of this Honourable Court.
14. LIMITATION: The cause of action accrued to the Plaintiff on cause_of_action_date when the Defendants cause_of_action_description. The present suit is filed within the period of limitation prescribed by the First Schedule to the Limitation Act 1908 and is otherwise within time.
15. NO PRIOR LITIGATION: There is no prior or pending litigation between the same parties in respect of the same subject-matter before any other forum, save and except prior_litigation_disclosure. The Plaintiff has approached this Honourable Court with clean hands and full and frank disclosure of all material facts.
16. COURT FEE AND VALUATION: The Plaintiff has valued the present suit at Rs. suit_valuation and has affixed the requisite court fee of Rs. court_fee_paid in accordance with the Court Fees Act 1870.
PRAYER
In view of the foregoing, the Plaintiff most respectfully prays that this Honourable Court, after hearing the parties and considering the evidence on record, may be pleased to:
(a) Pass a decree declaring that the Plaintiff is the lawful, sole, and absolute owner of the suit property described in paragraph 2 above, and that the Defendants have no right, title, or interest in the said property;
(b) Pass a decree of permanent injunction restraining the Defendants, their agents, servants, attorneys, and any person claiming through them, from interfering with the Plaintiff's title and / or peaceful possession of the suit property;
(c) Pass a decree cancelling and declaring void any document or instrument relied upon by the Defendants to support their adverse claim, including but not limited to adverse_documents_to_cancel;
(d) Direct the Defendants to deliver to the Plaintiff possession of any portion of the suit property of which the Plaintiff has been dispossessed, together with mesne profits at such rate as this Honourable Court may determine;
(e) Award the Plaintiff costs of the suit; and
(f) Grant any other or further relief that this Honourable Court may consider just, fit, and proper in the facts and circumstances of the case.
