DEED OF SURRENDER OF TENANCY

This Deed of Surrender is made on deed_date

BETWEEN: tenant_name, son/daughter of tenant_father, resident of tenant_address, CNIC No. tenant_cnic ("the Tenant") AND: landlord_name, son/daughter of landlord_father, resident of landlord_address, CNIC No. landlord_cnic ("the Landlord")

WHEREAS

WHEREAS by a tenancy agreement dated tenancy_agreement_date, the Landlord let out to the Tenant the premises described in Schedule A; and WHEREAS the Tenant now desires to surrender the tenancy back to the Landlord with effect from surrender_effective_date, and the Landlord has agreed to accept such surrender on the terms set out herein; the Parties agree as follows.

1. SURRENDER: The Tenant hereby surrenders the tenancy and the premises described in Schedule A to the Landlord with effect from the Surrender Effective Date, and the Landlord hereby accepts the surrender.

2. PROPERTY SURRENDERED: The premises being surrendered are: property_description, situated at property_address, comprising covered area of covered_area.

3. POSSESSION: The Tenant has, on the Surrender Effective Date, delivered to the Landlord vacant peaceful possession of the premises, with all keys handed over and all goods removed, and the Landlord has accepted such possession.

4. CONDITION ON SURRENDER: The Tenant has restored the premises to substantially the same condition as at the commencement of the tenancy, ordinary wear and tear excepted, with all alterations / fit-out works either reversed or assigned to the Landlord by mutual agreement as set out in Schedule B.

5. PAYMENT OF DUES: All rent up to the Surrender Effective Date has been paid by the Tenant. All utility bills and maintenance charges have been settled and the relevant proof has been provided to the Landlord.

6. RETURN OF SECURITY DEPOSIT: The Landlord shall, within deposit_return_days days of the Surrender Effective Date, refund to the Tenant the security deposit of Rs. deposit_amount less lawful deductions in respect of unpaid rent / utility bills / damages, the calculation of which is set out in Schedule C.

7. MUTUAL RELEASE: With effect from the Surrender Effective Date, the Tenant and the Landlord mutually release each other from all obligations and liabilities under the tenancy agreement dated tenancy_agreement_date, save such obligations as are expressly preserved in this Deed of Surrender (including return of security deposit and any post-tenancy survival clauses).

8. INDEMNITY: Each Party indemnifies the other against any liability under the tenancy agreement attributable to its own conduct, including any claim by third parties such as utility companies, society management, or successive tenants.

9. EARLY SURRENDER PAYMENT: Where the surrender takes place before the expiry of the agreed term, the Tenant shall pay to the Landlord early_surrender_compensation as compensation in lieu of completing the term, by way of mutual settlement.

10. STAMP DUTY: This Deed shall be executed on stamp paper of the prescribed value under the Stamp Act 1899 and may be registered with the Sub-Registrar where the original lease was registered.

11. NOTICES: All notices in connection with this Deed shall be in writing and delivered by registered post / courier to the addresses set out above.

12. GOVERNING LAW: This Deed shall be governed by the Punjab Rented Premises Act 2009 (or analogous provincial law), the Transfer of Property Act 1882, and the laws of the Islamic Republic of Pakistan.
